These Terms and Conditions govern your use of the Suncoast Pilates website,
contact forms, communications, classes, appointments, packages, memberships,
and related services.
Suncoast Pilates is operated by Flamingo Pilates LLC.
In these Terms, “Suncoast Pilates,” “we,” “us,” and “our” refer to Flamingo
Pilates LLC operating the Suncoast Pilates business.
By accessing our website, submitting a form, purchasing a service, booking an
appointment, or participating in our services, you agree to these Terms.
Consent to receive SMS text messages is separate and optional.
1. SMS Program Description and Messaging Use Cases
The program is called the
Suncoast Pilates SMS Program and is operated by Flamingo
Pilates LLC through the Suncoast Pilates brand.
Customers who actively opt in may receive recurring informational,
customer-care, and promotional SMS text messages from Suncoast Pilates.
Informational and customer-care messages may include:
- Responses to website enquiries;
- Customer-support communications;
- Appointment coordination;
- Booking confirmations;
- Class or appointment reminders;
- Schedule changes;
- Service notifications; and
- Follow-up communications concerning an existing enquiry.
Marketing and promotional messages may include:
- Class availability;
- Upcoming events;
- Introductory offers;
- Special offers and discounts;
- Promotions; and
- Service announcements and updates.
Marketing text messages will only be sent when the customer has separately
provided marketing SMS consent.
2. SMS Consent
SMS consent is optional and is not a condition of purchasing goods or
services from Suncoast Pilates.
To provide consent, a customer must enter a telephone number and actively
select the applicable optional SMS consent checkbox on a Suncoast Pilates
website form.
Marketing and non-marketing SMS consent choices are separate, optional, and
unchecked by default. Customers may submit the form without selecting either
SMS consent option.
Providing a telephone number without actively selecting an SMS consent
checkbox does not constitute consent to receive automated or recurring text
messages.
3. Message Frequency
Message frequency varies. Frequency depends on your
enquiries, appointments, account activity, communication preferences, and the
categories of messages you agreed to receive.
4. Message and Data Rates
Message and data rates may apply to messages sent to you from
us and to messages you send to us.
Contact your wireless provider for information about your text messaging and
data plan.
5. How to Opt Out — Text STOP
You can cancel the SMS service at any time. Text STOP or reply STOP to any
Suncoast Pilates text message.
After you text STOP, we may send one final SMS confirming your unsubscribe
status. Following this confirmation, you will no longer receive SMS messages
covered by that opt-out request unless you later provide new consent.
6. How to Rejoin
To rejoin after opting out, submit a Suncoast Pilates website form again and
actively select the relevant SMS consent checkbox.
You may also reply START where that keyword is supported.
Messages will only resume after valid consent has been received.

8. Carrier Liability Disclaimer
Carriers are not liable for delayed or undelivered messages.
Message delivery depends on the availability and operation of your wireless
carrier, network, telephone service, and mobile device. Delivery is not
guaranteed.
Suncoast Pilates is not responsible for delays, failures, or errors caused by
carriers, networks, mobile devices, incorrect telephone numbers, or
circumstances outside our reasonable control.
9. Age Requirement
You must be at least 18 years old to independently opt in to the Suncoast
Pilates SMS Program.
A parent or legal guardian must provide any required authorization for
communications concerning a participant under 18 years old.
10. SMS Privacy
Mobile telephone information, SMS opt-in records, and messaging consent will
not be provided to outside organizations or affiliates for their own
marketing or promotional purposes.
Text messaging originator opt-in data and consent may only be provided to
telecommunications carriers, messaging aggregators, and service providers
required to operate and deliver the text messaging service.

Information collected through the Suncoast Pilates SMS Program is handled
according to our

12. Industry Standards and Legal Compliance
The Suncoast Pilates SMS Program is intended to operate in accordance with
applicable laws, carrier requirements, and text messaging industry
standards.
Additional restrictions or requirements may apply under federal, state, or
local law. Nothing in these Terms limits any consumer right that cannot
lawfully be limited.

14. Eligibility for Services
You must be at least 18 years old to independently purchase services or enter
into an agreement with Suncoast Pilates.
A parent or legal guardian must provide any required authorization for a
participant who is under 18 years old.
You agree that the information you provide through our website, registration
system, contact forms, scheduling software, or other systems is accurate and
current.
15. Health and Fitness Disclaimer
Pilates, yoga, barre, strength training, stretching, and other physical
activities involve inherent risks.
Before beginning an exercise program, you should consult a qualified
healthcare provider, particularly if you:
- Have an existing medical condition or injury;
- Are pregnant or have recently given birth;
- Experience pain, dizziness, breathing difficulty, or other symptoms;
- Have been advised to restrict physical activity; or
- Are uncertain whether an activity is appropriate for you.
Information provided through our website, instructors, emails, text messages,
or other communications is for general educational purposes and is not
medical advice, diagnosis, or treatment.
You are responsible for informing your instructor of any relevant injury,
condition, limitation, pregnancy, or change in health before participating.
These Terms do not replace any separate liability waiver, health
questionnaire, informed-consent agreement, or studio policy required before
participation.
16. Appointments and Scheduling
Class schedules, instructor availability, appointment times, and service
offerings may change.
A booking is not guaranteed until it has been accepted or confirmed through
our scheduling system, by a Suncoast Pilates representative, or through
another confirmation method provided by us.
You are responsible for reviewing the date, time, location, instructor, and
service details associated with your booking.
17. Cancellation Policy
Suncoast Pilates requires at least
12 hours’ advance notice when cancelling or rescheduling an
appointment or session.
Late cancellations and missed appointments may result in the session being
charged, deducted from an existing package, or treated as used.
Cancellations should be completed through the available online scheduling
system or by contacting the studio.
Different conditions may apply to workshops, instructor-training programs,
events, memberships, or other services. Specific conditions presented at the
time of purchase will apply to that purchase.
18. Purchases, Refunds, and Expiration
Unless otherwise stated in writing at the time of purchase:
- Purchases are non-refundable, except where required by law;
- Packages and session credits are personal and may not be transferred
without written approval; - Packages may expire 60 days after the date of purchase; and
- Unused sessions may be forfeited after the applicable expiration date.
Memberships, workshops, teacher-training programs, events, and promotional
offers may have separate payment, cancellation, and expiration conditions.
Where product-specific conditions are presented during checkout or
registration, those conditions will control if they directly conflict with
this section.
19. Prices and Payments
Prices may change at any time. A price change will not normally affect a
completed purchase unless an obvious pricing or technical error occurred.
You authorize Suncoast Pilates and its payment-service providers to charge
the payment method supplied for the services, packages, memberships, fees,
taxes, and other amounts disclosed at the time of purchase.
We do not ordinarily store complete payment-card information when payment is
processed by an external payment provider.
20. Website Contact Forms
Our contact forms may allow you to submit information including your name,
email address, telephone number, service interests, and message.
Submitting a contact form does not automatically create an appointment,
guarantee availability, or complete a purchase. A Suncoast Pilates team
member may contact you to respond to your request.
Providing a telephone number does not, by itself, constitute SMS consent.
SMS consent must be provided separately through the applicable optional
consent checkbox.
21. Electronic Communications
When you contact us electronically, we may respond through the communication
method you used or another method you have separately authorized.
Email consent and SMS consent are treated separately. Unsubscribing from one
communication channel may not automatically unsubscribe you from another.
22. Intellectual Property
Unless otherwise stated, the website and its text, graphics, logos,
photographs, videos, designs, class descriptions, training materials,
downloads, and other content are owned by or licensed to Suncoast Pilates.
You may access the website for personal, non-commercial purposes. You may not
copy, reproduce, distribute, sell, modify, republish, or commercially exploit
our content without prior written permission.
Third-party trademarks, product names, and logos remain the property of their
respective owners.
23. Acceptable Website Use
You agree not to:
- Use the website for an unlawful, fraudulent, or abusive purpose;
- Attempt to gain unauthorized access to our website or systems;
- Introduce malware, malicious code, or harmful technology;
- Interfere with the website’s operation or security;
- Submit false or misleading information;
- Impersonate another person;
- Scrape or harvest information without authorization; or
- Use our website or communications to harass employees, instructors,
customers, or other individuals.
We may restrict access when we reasonably believe the website or services are
being misused.
24. External Services
Our website may connect to independently operated services for scheduling,
payments, communications, maps, social media, software applications, or

Those services may have their own terms and privacy practices. Suncoast
Pilates is not responsible for the content, availability, security, or
independent conduct of an external service.
25. Website Availability and Accuracy
We aim to keep website information accurate and current, but we do not
guarantee that all content will always be complete, error-free, or
immediately updated.
We may change or remove website content, prices, class schedules, instructor
information, promotions, services, or functionality without notice.
26. Disclaimer of Warranties
To the fullest extent permitted by law, the website and online content are
provided on an “as is” and “as available” basis.
We do not guarantee that:
- The website will be uninterrupted or error-free;
- Every service will be suitable for every individual;
- Participation will produce a specific fitness, health, or performance
result; or - Information transmitted electronically will always be secure.
Nothing in these Terms excludes a warranty or consumer right that cannot
legally be excluded.
27. Limitation of Liability
To the fullest extent permitted by law, Suncoast Pilates and its owners,
employees, instructors, contractors, and representatives will not be liable
for indirect, incidental, special, punitive, or consequential damages arising
from your use of the website or electronic communications.
Liability relating to participation in classes or sessions may also be
governed by a separate waiver or participation agreement accepted by the
participant.
Nothing in these Terms limits liability that cannot legally be limited.
28. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless
Suncoast Pilates, its owners, employees, instructors, contractors, and
representatives from claims, losses, liabilities, and reasonable expenses
resulting from:
- Your unlawful use of the website;
- Your material violation of these Terms;
- Information you knowingly submit that is false or unauthorized; or
- Your infringement of another person’s rights.
29. Governing Law
These Terms are governed by the laws of the State of Florida, without regard
to conflict-of-law principles.
Any legal proceeding relating to these Terms or the website must be brought
in a court with appropriate jurisdiction in Pinellas County, Florida, unless
applicable law requires otherwise.
30. Changes to These Terms
We may update these Terms to reflect changes in our services, policies,
technology, or legal obligations.
The revised version will be posted on this page with an updated effective
date. Your continued use of the website after an update constitutes
acceptance of the revised Terms where permitted by law.
Changes to the SMS Program will apply prospectively and will not expand the
scope of previously provided consent without any additional consent required
by law.
31. Severability
If any part of these Terms is found invalid or unenforceable, the remaining
provisions will remain in effect.
32. Entire Agreement
These Terms, our Privacy Policy, applicable purchase conditions, studio
policies, and any separately signed waiver or agreement constitute the
agreement governing the applicable service.
A specific signed agreement or product-specific condition will control if it
directly conflicts with these general Terms.
